What is Family Law?

Thank you for your great attention to detail.

People talk about "Family Law" but what does it involve?

More often than not, people engage a family lawyer because they want to get “divorced”.

It is correct that family law deals with matters such as divorce, which is the legal termination of a marriage, however the application of family law has a far broader reach.

As family lawyers, our work includes the following areas:

Parenting Matters

Parenting matters relate to the care of children. They address parental responsibility, such as where your children attend school, their medical treatment, religious upbringing and where they live.

This also includes how much time children spend with each parent after separation.

It can also include the following:

  1. The rights of third parties, such as grandparents and step-parents to spend time with children;
  2. International and interstate relocation and child recovery orders;
  3. Child protection;
  4. Adoption;
  5. Surrogacy;
  6. Fertility treatment and reproduction.

Property Matters

The law in respect to property matters deals with the division of property when parties separate.

However, it also has a much broader application in estate planning and asset protection.

This includes financial agreements which can deal with property owned by parties prior to the commencement of a relationship, at the commencement of a relationship or during a relationship.

Property matters can often involve the following:

  1. Complex corporate structures;
  2. Tax issues;
  3. The interest of third parties; and
  4. Insolvency and Bankruptcy.

Child Support and Spousal Maintenance

Family lawyers provide advice on various means of financial support available to parties and children after a separation.

Family Violence

We provide advice to parties in situations of family violence and provide support and representation throughout the Court process.

We can also give advice as to resources and options available to all parties involved in circumstances of family violence.

At Coote Family Lawyers we provide advice in all areas of family law.

If you need assistance with navigating your separation, estate planning or in relation to care arrangements for children, contact one of our team of top family lawyers in Melbourne on 03 9804 0035.
